TERMS OF USE

These Terms of Use (hereinafter – the Terms) govern the use of the website www.flautuparadize.lv (hereinafter – the Website), operated by SIA "Flautu Paradīze" (registration number 40203533087, legal address: Dzirnavu iela 100 k-3, LV-1050, Riga) (hereinafter – the Seller). By using the Website or placing an order, you agree to these Terms.
1. GENERAL TERMS
1.1. These Terms are binding for all Website users and govern the ordering of goods, payment, delivery, and returns.
1.2. By placing an order on the Website, the user confirms that they have read and fully agree to these Terms.
1.3. The Seller reserves the right to amend these Terms at any time. Changes take effect upon publication on the Website and apply to all orders placed thereafter.
2. ORDERS AND PAYMENTS
2.1. To place an order, the user must provide accurate and complete information (e.g., name, surname, email, delivery address). The user is responsible for any incorrect information provided.
2.2. The Seller will confirm the order only after payment is received, unless otherwise specified.
2.3. Available payment method:

Bank transfer via internet banking
2.4. Prices on the Website include VAT (value-added tax), if applicable, and any other associated charges, unless stated otherwise.
3. DELIVERY
3.1. Goods are delivered to the specified address using the Seller’s chosen delivery partner (Omniva).
3.2. Delivery fees and timelines are specified after placing the order.
3.3. The Seller is not responsible for delivery delays caused by the logistics provider or the customer.
3.4. The Seller is not liable for any damage to goods during transport. Customers are advised to carefully inspect the shipment upon receipt.
4. RIGHT OF WITHDRAWAL AND RETURNS
4.1. Consumers have the right to withdraw from a purchase within 14 days of receiving the item, in accordance with the Latvian Consumer Rights Protection Law, except in the cases mentioned below.
4.2. The right of withdrawal does not apply to:

Custom-made goods (e.g., pillows, instrument parts)

Opened items that cannot be returned due to hygiene reasons (e.g., flute cleaning cloths, cleaning tools, lip plate stickers, thumb rests)
4.3. To exercise the right of withdrawal, the consumer must complete a withdrawal form or submit a written request and send it with the return or via email to info@flautuparadize.lv.
4.4. The returned item must be sent to: Omniva parcel machine, Riga, Tallinas iela 86. The customer covers return shipping costs unless the item is defective or incorrectly delivered.
5. PRIVACY POLICY
5.1. The Seller processes personal data in accordance with applicable laws and the Privacy Policy.
5.2. Personal data is used solely for order processing, delivery, and communication with the customer.
6. INTELLECTUAL PROPERTY RIGHTS
6.1. All content on the Website (texts, images, logos, designs) is the property of the Seller or used under appropriate license. Unauthorized use is prohibited and protected by copyright laws.
7. LIMITATION OF LIABILITY
7.1. The Seller is not liable for technical issues related to Website operation or for any loss resulting from Website usage if caused by circumstances beyond the Seller’s control.
8. DISPUTE RESOLUTION
8.1. Any disputes shall be resolved through negotiation. If no agreement is reached, the dispute will be settled in the courts of the Republic of Latvia in accordance with applicable laws.
9. FLUTE REPAIR SERVICES
9.1. Service Description:
Flute repairs include diagnostics, damage repair, part replacement, and other technical maintenance as requested by the customer.
9.2. Service Intake:

9.2.1. Flutes are accepted for repair only after the client provides the necessary information (name, contact details, instrument description).

9.2.2. Prior to starting the repair, the technician will perform diagnostics and provide a cost estimate.

9.2.3. The client must confirm agreement with the estimated costs before work begins.
9.3. Completion Timeframes:

9.3.1. Completion time is agreed upon individually and may vary depending on the scope of work and availability of parts.

9.3.2. The Seller will promptly inform the client of any delays.
9.4. Repair Warranty:

9.4.1. The Seller provides a 3-month warranty for the completed repair work, except in the following cases:

The flute is physically damaged (e.g., dropped or bent)
-
Temperature guidelines are not followed
-
The flute is not properly maintained (e.g., moisture left inside after playing)

Damage results from improper use or external factors
-

9.4.2. The warranty only covers the specific parts and repairs performed.
9.5. Payment and Prepayment:

9.5.1. Repair costs must be paid upon completion unless a prepayment for parts was agreed.

9.5.2. In cases where repairs are not completed (e.g., customer cancels), the diagnostic fee must still be paid.
9.6. Instrument Responsibility:

9.6.1. The Seller is responsible for the safety of the flute during the repair and will return it in the agreed condition.

9.6.2. The Seller is not liable for damage if the instrument is not collected within 2 weeks after completion. Additional storage fees may apply thereafter.
9.7. Post-Repair Handover:

9.7.1. Instruments are returned only after full payment for the repairs.

9.7.2. Upon completion, a handover document is issued detailing the work performed and the instrument’s condition. The client must review and confirm it with a signature.
